He does have a perfectly legal right to backup media.
The RIAA/MPAA also don't *HAVE* to co-operate in assisting him in exercising that right. And now, they can be downright assinine about it and employ measures to stop it, and jail people who assist him (ie. the authors of such tools such as DeCSS), but they can't jail him specifically (the DMCA doesn't have any provisions for prosecuting people who use said tools, only those who provide them)
