We already use the GPL to fight fire with fire in respect to copyright. Its time to do the same for patents.

It's already being done. A non-profit has been set up and recently negotiated the acquisition of some non-trivial software patents. I don't remember where I saw this, but probably on either/and Slashdot or Groklaw within the last six months or less.
