It's quite possible that the Iphone was manufactured by a non-traditional cell 
phone company like Flextronics. So therefore they were probably less familiar 
with what the rest of the industry was doing.

It is also worthwhile to point out that the EU probably would not
have passed those laws had it not been for decades of lobbying by
outfits like Greenpeace. It is also worthwhile to point out that
the US is lagging the EU in these areas as they are in many areas
of social concern e.g. health care where essentially every nation
in the EU has beeter statistics than the US.
