You've heard of Mono, yes? Why can't you rewrite Mono to "go around" any patent?

So far they won't tell anyone what patents apply. You would have to go
to the point of no return by getting sued for them to be revealed in
court and by then it's too late. You have already violated them.

I suspect they won't say for a couple reasons:

1. Some are probably very questionable and if brought to light, they would be (what's the word?) overturned.

2. There aren't any they know of currently and it's just a threat.

3. They hope there are some and are still looking, but in the mean time they are seeking more leverage by the threat that there are.

4. They want to suck companies/people in so they can a) make more money on licensing now, b) make more money later with lawsuits against unsuspecting companies/people.

Remember that M$ has never invented anything, and this include Bill Gates. Everything they have has been stolen, purchased, or otherwise acquired for other sources. Chances are high that some/many of these so called patents came from somewhere else and the underlying technologies involved have been used for years before M$ even had them. This doesn't matter though because there are few companies with enough money or big enough brass balls to take on M$ in court even when knowing M$ would eventually lose. M$ does not go after such companies either, they only go after the ones they feel will buckle.
