In Italy we have two kind of aviation: General Aviation (GA) and VDS (Volo da Diporto o Sportivo, that is ULM).
The former, in case of homebuilding, requires that the RAI (the italian registry for aircrafts) is informed before starting the construction, so they can assign your project to an engineer that will become close to you as a brother and will follow you during the whole process until certification. The latter refers to "flying things" whose take off weight is less than 450 kg (for two seats), flying with certain limitation. Roughly: 1000 feet agl max (500 in business days), no CTR crossing, no radio on board (actually changing this one). The advantage is that you maintain your plane as the only person responsible, no paperwork is needed for your activity (apart from medical). The law here does not state any distinction betweeen ready-to-fly planes and kit-built or homebuilt. You build your plane then the AeCI (Aeroclubd'Italia) verifies that it's compliant to the ULM limitations and that's it.
