It is my understanding that the 51% rule states that the aircraft has to be built (51%) by an amateur builder. If you buy the project from a qualified individual, and have the build history documentation, it is still qualified for the experimental category: If the original builder(s) did not apply for the A&P amateur certificate you may be considered qualified to do your own work on the plane (if you can't prove that you contributed a significant amount of the build, you probably won't qualify). If the 'other guy' has already applied you are SOL. If you can't document that the plane was made to the content requirement, again, you are SOL. I'm not an expert, but that is my understanding (more or less).
