HAVANA TIMES, Dec. 27 – Cuban Gerardo Hernández, one of the five prisoners
in the United States charged with espionage, changed his defense strategy by
highlighting that he was unaware of the intention of the island’s government
to down the Brothers to the Rescue light aircraft in 1996 and recognizing
that the event took place in international waters, according to details of
his ongoing appeal reported by the Miami

Another big story this weekend: Gerardo Hernandez, one of the five
Cuban xxxxx convicted of conspiring to commit illegal acts, has changed his
story in an attempt to undo his conviction. In 1996, the Cuban military shot
down a Brothers to the Rescue plane, killing four, and Hernandez became the
only one of the five xxxxx convicted of involvement in the incident and the
only one to receive a life sentence. In his trial, Hernandez based his
defense in part on the assertion that the plane had been shot down over
Cuban territory. He now says the plane was attacked outside of Cuban

consistence with U.N. and U.S. government reports, and wants his conviction
overturned because of inadequate legal defense.

The Cuban five are heroes in the eyes of the Castro
government<http://www.cubadebate.cu/series/cinco-cubanos-prisioneros-en-estados-unidos/>(
and most of the world-Cort)and have attracted significant
international
support to get their convictions overturned. Former head of the U.S.
Interests Section in Havana, Wayne Smith, has defended the release of the
Cuban five <http://www.thenation.com/article/37396/free-cuban-five>, arguing
that they were spying on exile organizations planning terrorist acts rather
than the U.S. government, and saying they are guilty only of being
unregistered agents of a foreign government. Hernandez's new position,
however, contradicts the Cuban government's continued assertion that it
attacked the Brothers to the Rescue plane over Cuban waters. At the time of
writing, the Cuban press had yet to post any articles on the subject.

 Jimmy Carter asked U.S.-Cuba documents to be

In 2002, former President Jimmy Carter asked the State Department to release
previously declassified documents on U.S.-Cuban relations, according to a
listing of declassification reviews.

Carter made at least 39 additional requests for the declassification of
State Department documents in the 1990s. His requests were granted, which I
imagine then allowed Carter to make public and write about the documents
without violating any secrecy laws.

The State Department listing doesn't give details about the documents.

I came across Carter's requests in a massive 1,400-page PDF, which was
posted on the GovernmentAttic <http://governmentattic.org/> website in
October. I am preparing Freedom of Information Act, or FOIA, requests in
connection with my research into U.S. government programs in Cuba. (See Cuba
Money Project <http://cubamoneyproject.org/> for details about that).
Scanning FOIA logs and reading letters of others who have made FOIA requests
gives me some insight into how these things work.

The State Department PDF shows a log of declassification reviews performed
from 1974 to 2010. You can download the 77.5 MB document from this
