Spiders, I contacted the UK Patents office and they wrote back first thing this morning - really lovely people and very helpful in going through the information on copying from out of print books.
Basically, under UK law, if a book or document is out of print the same restrictions to copying it apply as if it was in print. Therefore, if you own the lace book / pattern you can copy it whether it is in print or out of print. If you don't own the book - you need to contact the author for permission to copy. Pure and simple.
