he would be sane enough to go through a trial.  

What is really weird about this is that the person was insane when he
did the crime, but sane when he is going through a trial, due to
medication.  So if he happens to get off, then refuses to take his meds,
he could repeat what he did all over again.  

IMO, these cases should be handled entirely different from other cases.
As in the case of the Unabomber, he is in prison for life.  Death for
these people just doesn't seem right. IMO
