During the week of 4/27/98, the United States Supreme Court will hear 
oral arguments in the case summarized below.

Pennsylvania Department of Corrections v. Yeskey
No. 97-634

Court below:  United States Court of Appeals, Third Circuit

At issue in this Americans with Disabilities Act (ADA) case is whether
the
ADA is applicable to inmates at state prisons who may qualify to be
accommodated under the ADA.

The Pennsylvania State Prison denied admission to Yeskey to enter the
"boot camp program", due to a history of hypertension, which Yeskey
claims
is a disability. Successful completion of the Program can shorten a
prisoner's time in prison.  Even though Yeskey was subsequently released
from prison, the court below held:  1) that the case was not moot
because
of Yeskey's claim for damages and the likelihood of a future ADA
challenge
being applicable to state prisons and 2) that institutions receiving
federal funds, such as the Prison, must abide by the rules and
regulations
promulgated pursuant to the ADA.
