Either modal forms are decorated, with title bar and borders, then they stay on top of their parent window, but can be covered by other unrelated windows, or they are without title bar and without borders (such as splash screens), and in that case they stay above any other window, but they will show in all desktops. Happens with Gtk, and with Qt also, because it's an X11 spec.
