Ok, so a way to turn the fixing off would suffice 
for you? I'm thinking in a new flag...

By the way, ICC profiles already have huge problems 
with highlights. Lab PCS doesn't even allow them. 
There is lately a lot of interest in ICC about digital cinema, 
so, maybe, some recommendations will follow on that... a  
couple of minor revisions ahead.
