I've looked through a lot (all ?) of the relevant USA patents in regard to tetrahedral interpolation, and basically yes, there are lot of patents on it - all of which have expired. [The original patents were mostly related to Crossfield hardware implementation patents, and these are quite old now.] There are still patents on various exotic variations on the algorithm, but you can have moderate confidence that the basic algorithm (as implemented in ArgyllCMS - I can't speak for lcms) is not subject to US patents. In any case, GPU texture lookup functions are likely to be multi-linear rather than tetrahedral based, and patents in this area are really the GPU manufacturers problem.
