BACKGROUND:
This discussion will be very important because it will form the basis
of the PSA response to the National Competition Policy Issues paper on          
the Review of SA's OHS&W Act (1986).
        
The paper was released on 6 June 2000 by the Workplace Relations                
Policies Division of DAIS. The PSA, the UTLC & the other unions  have
been concerned at the simplistic, economic rationalist and hostile tenor
of the document to the need for a sound, preventative approach to OHS&W         
legislation.
        
Instead the authors seem to promote the concept that the OHS&W                  
legislation  is a restriction to market place competition.
        
In 1998, we were compelled to spend time and energy on responding to the        
Public Discussion Paper on SA's OHS&W Regulatory System. This was               
produced by DAIS and WorkCover and was a thinly veiled attempt to scrap         
our OHS&W Regulations. The union movement allied with more responsible          
employers prevented this from happening.
        
If there is widespread credence given to this latest issues paper, our          
OHS&W legislation could be at threat. This is why we must take it               
seriously and respond decisively.
        
One cause for hope on the horizon is that the WorkCOver Corporation has         
distanced itself from this particular paper.
        
We need to respond decisively and in doing so, we should demand that:
        
* OHS&W be treated as a basic human right
        
* far more effective enforcement policies are needed to protect workers
        
* our OHS&W legislation is broadened
        
* DAIS Workplace Services & WorkCover develop more effective strategies
   to halt the unacceptable level of occupational death, injury and             
   disease in Australia and South Australia
