There is an option on the marriage screen to choose their marriage status
and you can choose 'unmarried'.  You could add your own 'status' of 'same
sex marriage' or whatever in that field; the problem is that you cannot
have two people of the same sex in a marriage.  You could add one as male
and one as female and identify them properly in your notes or something ?
I'm sure this is a very common occurrance these days but the subject of
same sex marriage has come up before and Legacy cannot form same sex
partnerships.

Also, this is not an LDS based program or an LDS based list; many people
happen to be LDS but I doubt that it's even the majority.  Most if not all
of the major genealogy programs now work with the LDS church's New Family
Search because it is of major interest to ALL genealogists although there
is a portion that is only accessible to LDS members.  The LDS church is a
major player in the genealogy world but this list and the program are by no
means LDS based. Hopefully that makes some sense.  I'd hate for anyone to
not ask a question that they need an answer to :-)

I am LDS and it doesn't matter whether I agree with what anyone else does
in their life; my goal is to research and record information as it really
is so this is of interest to me as well.
