Thanks for the clue. Turns out that was not the problem, the actual problem was one of my pictures somehow had it access rights changed, corrected that and all is well.

Because the file is open Legacy's backup is prevented from opening the file to add it to the .zip file. I do not ever remember receiving that message when selecting media files.
