Jon,
If you are following the directions at Support for error 3022 and
exporting to a new Legacy file, the people will still be marked private
in the new file provided you follow the directions and include them in
the export.

Go to Search > Detailed Search > under first condition (top row)
"Look for whom?" Individual
"Where to look" Private
"Equal to" Private
Check Clear list before this search. (at bottom left.
click on Create List.
When the list opens select an unused tag to tag everyone in the list.
