Jonathan,

Options > Customize > Data Defaults gives you the option to select the
Living Indicate Default to "Yes", "No" or "Use Previous"

  By default Legacy codes all new additions as living if they don't have a
death date. An absent-minded genealogist can enter a lot of people from
bygone centuries before they wake up and remember to click "no" on Living.
