On the crudest of linguistic levels, I guess that one could say that,
but I think that in this context the phrase "to steal" is rather
misleading.
The appeals court not only echo Alsup's language choice, but write that,
to apply his reasoning to other software, it's hard to come to any other
conclusion. Yes, I deliberately chose inflammatory language, exactly
because it was so interesting.
