My ex-husband and I have a parenting plan which is approved and signed
by Judge Brown in Hamilton County Chancery Court. One of the
stipulations in this agreement is about moving out of the area further
than a hundred and twenty miles without a sixty day warning and chance
to contest the move. My ex-husband has packed his belongings and
taken the kids and has quit his local job. The rest of his family has
already moved to another state and his new wife's parents have made
the offer for them to stay while he gets on his feet in this new
location. He refuses to answer questions about the "extended
vacation" which is also against the parenting plan. The question I
have, being that I have little financial means and little knowledge of
the law; how do I stop the move and basic kidnapping. I'm scared that
I would have no way to reverse such a move or get the kids back. He
has broken almost every stipulation of the parenting plan in the last
few months and I can't get an answer on how to stop this one. Any
advice would be wonderful.
