Well, there's a proposal to change that at
http://www.ussg.iu.edu/hypermail/linux/kernel/0609.2/0351.html:
"I'd like to move to a scheme where we do headers_install and
headers_check _without_ starting with a rm -rf
$(HDR_INSTALL_PATH)/include."
So, yes, at the moment one has to be careful, but I can't see this being
a problem for much longer (I say, crossing fingers that whatever
mechanism is devised makes it into 2.6.18!). Even if it doesn't make
the cut, I don't see a problem going ahead with using the
headers_install target with a suitably prominent warning.
