My thoughts are that if you're interesting enough to an authority - they would likely be aware of such canary in use. And ppl have to be aware of it for it to be useful. If you don't publicize it as a "feature" until after you've been served papers, they'll call it obstruction. And I would think a NSL that could tell you to preserve anything - could also tell you to keep this file in a running state.
