You mean as opposed to "inherent authority" of the "commander in chief"
to order a civilian agency to engage in warrantless wire taps. Seems to
me that government authoritarians can exploit the "real authority" of
the constitution just as well as its lack of real authority. At least
if "the people" understood that the constitution has no authority, they
would not depend on it to protect them from despots.
