The recent dialogue concerning homosexuals marrying is ironic to most
libertarians. To start, the government should not be licensing marriage. To
receive a marriage license from the state is to receive permission to get
married. Why would Americans need permission for any personal choices that do
not affect others? What are we getting permission to do?
So, where does the government come into marriage? One of the roles of
government is to secure contracts, including marriage contracts. We use civil
courts and government force to uphold contracts. Today, when two parties enter
a contract they do not pay fees to insure their contract. The costs are paid by
taxpayers. This should be changed.
When two persons marry, on a legal level, they are contracting with each other.
Today, these contracts most often are one-size-fits-all, with the state
deciding the agreement parameters, instead of being individually customized.
But, as far as which contracts the government secures, discrimination is unjust
and illegal. Any cognitively-competent adult persons, homosexual or otherwise,
can enter into a contract together. An intolerant majority may not infringe on
individual rights. And, as far as marriage goes, couples have every right to
seek out a religious organization that may choose to marry them before their
deity; another place government should have no influence.
All Americans interested in tolerance, fairness and individual rights should
vote for libertarian candidates, who understand the limits of public intrusion
into private lives.
