Two options both legal by the geniva conventions. 1) Delclare them to be PWs and then they can be held until the war on terror is over which will be in about 75 to 100 years from now and they then could not be tried in a civilian court, as per the treaty. 2) Keep their status as unlawful combatants defined as per Article 4 by omission. Article 4 explicitly defines everyone covered by the conventions and a reading of that article points up the fact that the prisoners at GITMO are not covered as they do not display a "fixed distinctive sign recognisable at a distance".
