On Tuesday, the New York State Court of Appeals upheld the decision of the New York State Supreme Court, 4th Appellate Division, overturning the City of Rochester's curfew law on the basis that it violates both the Constitution of the United States, and the Constitution of the State of New York.
The Libertarian Party of New York applauds the decision of the court. As the court determined, the City of Rochester's curfew ordinance unlawfully restricted the right of citizens to freely associate and peaceably assemble, and interfered with the right of parents to direct and control the upbringing of their children. We urge other municipalities in New York State to heed the court's decision, and respect the New York State and United States Constitutions, by immediately ceasing enforcement of any curfew ordinance currently be in effect, and repealing any such ordinance as soon as legislative schedules permit.
