Now read the dissenting opinions. The majority focused on one kind of abuse, the minority on another kind. The majority decided to give the bench discretion to avoid the first, but the dissenters pointed out that discretion could be abused. Your attitude essentially depends on whether you trust judges. Can you trust judges with that kind of discretion? I don't think so. We need to leave those kinds of decisions to juries.
