Are you constructing your own or referencing the one inside the mesh?  You can 
construct a locator on a refined mesh and that works. If you then refine the 
mesh the locator needs to get reset with the new mesh, or could contain 
references to deleted elements. 

I believe the locator inside the mesh does this automatically.
