It makes a difference as to whether they intended to kill my family or not. A police officer in a firefight with a criminal fires a shot that goes through a window and kills a loved one. If there is some evidence of recklessness, I want to sue. Someone on a lark fires a shot in my neighborhood, it goes through a window and kills a loved one, I want him in jail on manslaughter and I want to sue so he's got nothing when he gets out.
