In my experience, developers of older non-AAA games are just happy to see their games still being played, in the same way that older indie musicians are just happy to see their music still being listened to. They usually don't have anything against sharing, hence the big "abandonware" scene for games.
But when it comes to source code, they frequently will object to sharing it on the basis of being ashamed of how amateur the code is. This is something the free software movement has historically been aware of, but something we still need to work on: people need to know that there's nothing shameful about having once been a beginner! Especially not if the end result has had a big impact on society in some manner or other. (One should however be ashamed to have proprietary software circulating upon learn that proprietary software is a wrongdoing.) If we can convince developers of defunct -- especially independent non-AAA -- games to release the source code, it would be fantastic.
