It's already illegal in the EU, according to multiple court rulings applying the EU treaties.

As far as I understand it, the Court ordered Lenovo to pay damages for charging for the copy of Windows that came pre-installed on the machine; that isn't to say that OEMs are now obliged to offer alternative OS installations.
