I am attaching a summary of the Federal Communications Commission’s (FCC) Affordable Connectivity Program (ACP) Transparency Order and Further Notice of Proposed Rulemaking (FNPRM) that WISPA’s outside counsel, Lerman Senter, prepared. WISPA greatly appreciates Lerman Senter’s excellent advocacy in this proceeding! Their advocacy resulted in several important policy victories in this proceeding that I have listed below. I also want to thank the firm for their quick summary of the Order and FNPRM. I have also attached a link to the actual FCC Order and FNPRM. Key WISPA Policy Wins: (1) Requiring only the collection of aggregate numbers of ACP households; no requirement yet for a subscriber level collection. (2) Not requiring the collection and publication of take rates and churn rates. (3) Tailoring the base forfeiture amounts to an ACP provider’s number of ACP households. (4) Requiring only annual publication of the aggregated number of ACP households. (5) Reliance on the broadband labels to collect plan price and characteristic information and consistency with broadband labels in reporting of price information. (6) Aggregating data at the ZIP Code level on a “snapshot” date.
