Technically, yes.  But Bill Shorten has to deal with the political realities.  
If Labor is in government after the May (?) election the legislation can be 
changed, but it certainly won't be changed if the Coalition is re-elected.  You 
choose....

Political history is littered with triumphs of Great Principle over political 
reality.  Remember how the Greens voted down the carbon-trading protocol worked 
out between Rudd & Turnbull because it wasn't good enough?
