I am in full agreement with what you have written except you are missing a vital
component in your last statement and that is "strong enforcement of the laws".

As is too often the case in many countries, there are laws but they are rarely
enforced and even when they are, the judicial sentence is nothing more than a
"slap on the wrist".

The best deterrent is almost always the probability of detection of the crime 
and
the extent to which the crime will be prosecuted.

Meanwhile in the real world, the security agencies and their unelected
bosses are actively engaged in doing their best to make the implementations
of encryption insecure.
