Its a legal ordering so it should only cause problems on faulty equipment. When looking at the icmp bear in mind that for all sorts of valid reasonable icmp cases the icmp error will be sent in response to either the entire packet having arrived, beeen reassembled and rejected or fragment 0 (on firewalls).
