McBride misses the facts.

The community caught the issue and removed it before it made it into mainstream code.  
The Linux kernel developers list has some of the best programmers in the world working 
on the linux kernel.  The community (or bazaar) worked exactly as it should have.  
Probably better than developers at a large corporation, because open source checks to 
make sure code is unencumbered before incorporating, whereas proprietary software 
developers knowling copy GPL'd code.  Remember the potential vulnerability in the zlib 
compression routines?  Anyone recall who had to admit to using the whole darn library 
because they were vulnerable as well?  Yep, that would be one of the companies that 
propped up SCO this year so they could claim a profit for its first quarter ever - 
Microsoft.

In my opinion, McBride (lowlife, sniveling dog that he is) nevertheless makes a valid 
point: that if Open Source does not have a mechanism in place to prevent a repetition 
of the SGI developer's violation of IP, then large enterprises will not take the risk 
of using it.
Why use an OS if it allows people like SCO to crawl out from under a rock with a 
multimillion dollar lawsuit in hand?

When they took the fourth amendment,

Now they've taken the first amendment,
   and I can say (or do) nothing about it.
The Second Amendment is in place in case they ignore the others.
