Whichever of Novell's lawyers wrote 4.16(b) deserves a medal. Whoever signed it at SCO deserves a smack in the face with a large rotten fish while balanced on a greasy pole over a cesspit. It would be interesting to know what the penalties are for non-compliance with Novell's demand.
