AFAIK (and with a lot of help from various organizations), all the IBM closed source bits are now gone from Linux (or have open source alternatives). The source may not be very readable/usable (cf the QDIO driver code for a prime example), but it is there. The other distinction is that you could build the core system without it and still have something that would boot; OpenSolaris cannot be built at all without the closed source code.
