US District Court Judge Colleen Kollar-Kotelly announced the date for the hearing late yesterday. The move followed a motion filed by Microsoft on 23 December seeking to delay the hearings already scheduled to start on 11 March. The dispute concerns remedies suggested by nine states that have rejected rival terms already accepted by Microsoft, the US Department of Justice (DoJ) and the remaining states that filed against the software giant. Under the original timetable, laid out by the judge three months ago, the remedy hearings were set to begin on 11 March, around the same time as hearings into whether the proposed settlement is in the public interest. Microsoft maintains that it needs more time to prepare because, in its view, the nine states in the case are seeking a "dramatic expansion" of possible sanctions. The company requested a delay until the late summer. But that request was met with opposition from the hold-out nine states. In a filing made on 31 December, urging the judge not to delay the remedy hearings, they maintained that Microsoft had plenty of warning of the broader measures they sought. If Microsoft is successful on 7 January it could help to limit remedies imposed on the company to those already agreed by the DoJ and the bulk of US states. Approval of that proposed settlement, far in advance of hearings on further remedies, would make the dissenting states' task far more difficult, according to legal experts.
