Actually I went back and dug up the actual reply from gibson. Here it is 
verbatim:

"We hold a patent on MaGIC, and have cleared any prior works. There is no
setup or per unit royalty on MaGIC Products. Development boards are sold
at cost.Our SDK is $2500. Neither the Development board or SDK is required
to make MaGIC enabled products, but it will vastly help you in your
development efforts.

All we ask is that you sign a royalty free license agreement, ad provide
a unit for interoperability testing."

So I guess its ok to implement MaGIC...
