A possible explanation:
- when diald starts it put a diald.pid somewhere (maybe /var/run) with its pid inside.
- when the script kills diald, it looks in the diald.pid file to see what process to
kill,
and than delete the file.
- when the script starts diald it first checks if the diald.pid file exists, if it does
than the script assumes diald is already running.
So, if you killed diald "by hand":
- the init script sees the diald.pid file and thinks that diald is already running;
- when it tries to kill the process it sees inside diald.pid it doesn't find it.
Find the diald.pid file and delete it.
