You can't assume anything. To do so is to risk a split-brain, that's the whole goal of fencing; It takes the guess work out. It allows the node to say, for sure, that the peer is in a known state. As soon as you guess, you risk problems.

Back to the original problem, you have a single point of failure in the WAN link between the nodes. It is impossible to distinguish a WAN failure from a site destruction.
