You can sue a lot of people you didn't pay to; if I give you a free security
advise (assuming I'm a real security expert) and it causes you damage, you
can sue me. If I run over you on the street without asking you to pay me
first, you can sue me (or your surviving family). Moreover, if I write a
program that formats your machine and distribute it (for free) as a
disk-space management system, you can probably sue me.
All this, unless you except (by clicking on a license, opening a
shrink-wrap, etc) the possible damages that can happen to you.
