While I'm sure you are right, I don't see how a license can bind me when I neither installed the software nor pressed "I Agree" on an EULA. Until I did, it's just a simple software sale, and first sale should apply. This is even before I mention that BUG already hit "I agree" for me, so there was no EULA visible to the end user at all.


Another question is whether I can buy Windows XP Home, and then bring the software back, say I don't agree to the EULA, and ask for a refund. This will just give me a 1000 sheqels discount on the entire machine.
