Machin hangs when stopping packets

Hello
When the 3c59x driver can't send a packet the hard_start_xmit returns 1,
but when it does that several times the machine hangs. 
How can I stop the packets in the driver and tell the layers above that
the adapter can't send any packets at the moment?
