I think the concern is really the statement that says that the firmware "may not be reproduced, used, sold or transferred to any third party without Keyspan's prior written consent". At face value that would appear to answer your question in the negative. Now it's clear that what that appears to say is not actually what Keyspan meant, since they released the firmware to Hugh Blemings specifically so it could be included (in binary form) in the kernel sources. Maybe that's just the copyright notice from their firmware source code or something. In any case, it needs to be cleared up.
