Something much like what you wrote is in there now.  If the first byte of
interrupt data from a CBI device is non-zero, it is treated as indicating
a failure rather than an error.  Does that suffice to handle your device
correctly?

If not, can you post a verbose usb-storage debugging log showing the exact 
problem?
