Yes. Apparently there's a small risk that it's not, but you'll have to
take that. Tell the vendor you're buying on condition that you can swap
the card for an intel-chip-based one, and keep the packaging intact.

A year out of date, otherwise fine. The "eval" might mean it's a live
DVD, in that case you can run from DVD but not install it. You can find
out easily by booting it in any PC - it starts up either an installer or
a desktop.
