Let me try to clarify the situation.  Note that anything I've contributed here 
is my own personal opinion and not any kind of official statement from ZigBee 
Alliance (ZA), Cisco or any legal opinion...

ZA has published a collection of specifications that are not IP-based.  I don't 
know much about them but I do know they are not GPL from ZA.

ZA has also published the ZigBee IP (Z-IP) specification, which is (at present, 
anyway) freely available.  Z-IP specifies the use of a collection of IETF and 
IEEE standards, implementations of which should be acceptable for inclusion in 
Linux.  Examples of those standards include 802.15.4, 6LoWPAN, 6LoWPAN-ND, RPL, 
MLE, PANA, TLS.  In more detail, Z-IP specifies how those standards are used 
(e.g., operational parameters, security protocols) to build an interoperable 
implementation of a device that can join and participate in a Z-IP mesh network.

There has been some confusion about the application of the term "ZigBee".  In 
my opinion, all of the component protocols pulled together under Z-IP are OK 
for implementation in Linux, and the Z-IP spec gives a useful guideline for an 
interoperable implementation of the suite of protocols.
