A friend has Windows installed on her desktop (by the
vendor) and called me for help because she keeps
getting messages about it not being a licensed copy.
Clearly this happens because MS is monitoring online
unlicensed copies (she didn't know the difference and
has asked the vendor to implement a license). 

If that doesn't count as spyware, then what does?
However, with all due respect to RMS, I prefer to
think of most implementations of the OS as malware
(and reserve my opinions only on the ones I haven't
tried myself).
